DEFINITION OF WORK-RELATED CASES

This document clarifies the definition of Work-related accidents and their requirement to be incorporated into CONTRACTOR’s accident statistics.

In principle, the judgement of whether an injury or illness is Work-related or not depends on whether at the time and location it occurred the individiual or the activity was under the CONTRACTOR’s control, regardless of the location, time, or the terms and conditions of the Contract.

However, in cases where it is not clear whether or not an incident is Work-related, the judgement will be made by the Incident Investigation Team members assigned by both the CONTRACTOR and Subcontractors, supported by COMPANY. The following examples are given:

Work and Activity Not Under The Control of CONTRACTOR The following cases are not deemed as Work-related: (1) (2) (3)

Work which is out of the scope of the Contract, unless the work involved is undertaken on the the project site using project equipment and manpower.

Work executed under the control of COMPANY or Third Party, even if CONTRACTOR’s equipment and/or personnel are involved by their request.

An injury or illness occurring at Subcontractor’s or Vendors fabrication yards, material/equipment stock yards, etc., which are located outside of the Construction Site, which are not subject to control by the CONTRACTOR, which are not dedicated to work for the CONTRACTOR and where the worked manhours are not recorded in the project statistics.

An injury or illness at a Camp and other facilities controlled and administered by the CONTRACTOR should be deemed as Work-related if it is a result of a failure in management control. Eg., due to poor hygeine, or failure in camp infrastructure, electrical, building fabric etc.

An injury or illness at camps and other facilities controlled and administered by the CONTRACTOR’s Subcontractors should not be considered as Work-related if the injury/illness resulted from personal activities during his free time, and not as a result of services or equipment provided by the subcontractor. (eg., food poisoning resulting form eating in the camp canteen would be work related, if it resulted from food prepared by the individual himself for his own use it is not work related).

Incident or illness at hotels or condominiums should not be deemed as Work-related, unless the accident / illness arises during entertainment purposes as part of the individual’s work.

Traffic accident on the Construction Site in the premises should be Work-related.

(2) Traffic accident outside of the premises should not be Work-related, unless the vehicle is

on project related business, eg., transporting workers, delivering materials etc. (3) Accident occurred on a ferry boat should not be considered as Work-related.

Transportation, Loading and Unloading of Equipment and Material (1) (2)

Natural Disasters Accident by, flood, typhoon/tornado, or lightning should not be considered as Work-related, if it is uncontrollable or not preventable. However CONTRACTOR and Subcontractor have the responsibiliity to cease all work and make work areas safe when advance warnings of such conditions are given. Others (1) (2) (3) (4)

Accident or injuries due to riot, strike or fights outside of the workplace should not be considered as Work-related.

Illness due to abuse of alcohol or drugs, or the lack of self-control should not be considered as Work-related.

An injury which occurs during lunch or off-duty period is not considered as Work-related unless it occurred due to hazards in the work area.

Any injury resulting from horseplay, fights, or assaults occuring on the work site should be considered as Work-related.

An accident occurred within the Construction Site while transporting or loading or unloading of equipment and material should be considered as Work-related.

While transportation of project equipment and materials, on project hired transport, an accident occurred outside of the premises, it should be considered as Work-related.
